Drew Findling, NBA YoungBoy’s defense attorney, believes the rapper’s federal gun case should be delayed pending further high court rulings on similar gun cases, which could set a new precedent and change the outcome of his trial. He made that argument in a brief filed last Monday. Prosecutors, on the other hand, argued that a similar case brought against Zaki Rahimi earlier this summer by the U.S. Supreme Court was sufficient.
YoungBoy’s legal team’s case relies on the notion that prohibiting someone, even a felon, from owning a gun is unconstitutional under the Second Amendment. In the case of Rahimi, the focus is on whether the person involved is considered a credible threat to society. Fielding, in turn, said that although Youngboy was a felon, it was never proven that he was still a danger. “In the aftermath of Rahimi, whether Congress can simply ban all convicted felons, regardless of the nature of the felony, from possessing firearms, or whether it can impose such a ban without an individual finding that a particular defendant poses a credible threat, It remains an open question for the safety of others, and ultimately, whether such a ban might be permanent,” he wrote.

Fielding wanted to delay the case to see what the outcome would be in United States v. Collette and Garland v. Range. YoungBoy’s trial begins on July 25. It has made many headlines, with fans at one point interrupting the courtroom to chant “free YB” and telling judge Spencer Walsh to “shut your asshole up”.
