Diddy’s lawyers reportedly insist he should be released because his bizarre behavior was just amateur porn.
On Thursday (April 9), the U.S. Court of Appeals heard Puff’s latest motion for release. Lawyers for the Bad Boy Entertainment founder argued that his bizarre behavior did not violate any laws and should be considered amateur pornography, TMZ reported.
“The Madness and the Hotel Night were choreographed sexual performances involving the use of costumes, role-playing and stage lighting that were filmed so that Combs and his girlfriends could later view the amateur pornography,” they said. “The production and viewing of such pornography is protected by the First Amendment and therefore cannot be prosecuted under the Constitution.”
During the hearing, Diddy’s attorney also raised the issue of Cassie’s drug use but was barred from appearing during the trial.
Last July, Dee Dee was found guilty of two counts of violating the Mann Act or transporting prostitution. His legal team said his sentence was grossly excessive, with the typical sentence for the charges being 15 months. Puff has already served 19 months in prison. It’s unclear when his appeal will be ruled on.
Diddy was originally scheduled to be released from prison on June 4, 2028. In March, his sentence was reduced by 40 days and he is currently expected to be released from prison on April 25, 2028.
