TI and his wife Tiny have reason to celebrate after they successfully argued and dismissed their California sexual assault case.
A representative for the couple told AllHipHop on Friday (August 9) that the case filed earlier this year by an unidentified woman has been officially dismissed.
“The court agrees with Tip and Tameka that Jane Doe does not appear to have any viable claims,” the representative explained. “As Tip and Tameka said three years ago, these accusations are just some of the many false, salacious accusations being thrown at the media in an effort to extort money from them.”
Last month, the rapper (born Clifford Harris) and his wife asked that the case be dismissed.
In another case in January, a woman named Jane Doe filed a lawsuit against two people, alleging “sexual assault, assault, neglect and false imprisonment” over a 2005 incident. At the time of the filing, the couple released a statement to HipHopDX, saying the plaintiffs “have been threatening to sue for three years.”
In a motion filed last month, the Harrises’ attorneys argued that “all of the claims asserted in the complaint are time-barred because the statute of limitations on such claims expired sixteen years ago. Furthermore, although defendant Clifford De Harris (“Mr. Harris”) and Tameka Harris (“Mrs. Harris”) (collectively, the “Defendants” or “Harris”) deny that any of the alleged conduct occurred, but the complaint is not merited. Facts to fully substantiate any claims alleged in the complaint.
The attorney’s statement continued: “Accordingly, Defendants seek to dismiss all claims in the Complaint… for failing to allege a claim upon which any relief would be granted. Because there is no possible remedy for these deficiencies… Defendants seek to dismiss the entire action.
Jane Doe cannot resubmit her complaint at this time.
According to the lawsuit, the Atlanta rap legend and his wife allegedly met with the plaintiff at a Los Angeles nightclub while he was in the military.
The woman thought Tiny might have tampered with one of her drinks before she and two other girls apparently ended up in a hotel room with the “You Know What” rapper and his wife. After taking a shower with the Southern presenter and his wife and giving him a massage while he watched porn, she claimed Tip penetrated her vagina with his toes, despite her repeatedly telling him not to.
“Are you okay? Looks like you’re last in line,” she claims he told her after she went to the bathroom to vomit.
The woman claimed to have passed out and was escorted out of the hotel room the next morning while still in “severe pain”.
