Christian Combs and his father Diddy tried to close the sexual assault lawsuit by debating the alleged incident.
In a motion filed in a federal court, both men’s lawyers asked the judge to abandon the case filed by yacht stewardess Grace O’Marcaigh, who claimed Christian Combs attacked one of her luxury ships in December 2022 in international waters near the U.S. Virgin Islands.
The defense depends on denying the allegations, but on the jurisdictional technology.
Christian’s legal team believes that even if the claim is true, California law does not cover behaviors that occur outside the state.
The lawsuit accuses Christians of being subjected to assault, assault, sexual assault, as well as negligence and intentional emotional distress.
Diddy was also named for allegedly fostering a “lawless atmosphere” on the yacht and repaying the captain for suppressing the incident.
Christian’s attorney clarified that because he is a California resident, they did not challenge the court’s jurisdiction over him. However, they insist that California cannot be applied to misconduct that occurs in international waters.
The incident was reportedly reportedly in a highly anticipated holiday charter for the Superyacht Victory on December 28, 2022. O’Marcaigh claimed Christian entered the yacht’s recording studio to revel in, ordering tequila for guests and crew, and later groping for her without permission.
She accused him of following her to another part of the yacht and trying to force her to have oral sex before her colleagues intervened.
She reported the incident to the captain the next day but said she was blamed for drinking with guests and being on duty. Diddy, who rented the yacht, paid the captain to keep the incident quiet, the lawsuit alleged.
If the court denies the motion to dismiss, Christian and Diddy will be expected to respond formally to the allegations.
