Diddy’s lawyers argued that the so-called bizarre tapes used by the government showed consensual sex.
Diddy’s legal team downplays alleged kinky tape
Diddy’s legal team filed a new motion in his criminal case on Tuesday (January 14), arguing they can gain electronic access to the alleged tapes involved. The tapes are currently only available for inspection by the defense due to a protective order. The Bad Boy Entertainment founder’s team says the tapes actually prove his innocence.
Diddy’s attorneys wrote: “The nine videos at issue are the so-called ‘Freak Off’ tapes of Victim 1, which the government has repeatedly mentioned and fueled frenzied media speculation.” Victim 1 has been identified For Puff’s ex-girlfriend Cassie Ventura. “Contrary to what the government has led courts and the public to believe, so-called ‘Freak Offs’ are private sexual acts between fully consenting adults in long-term relationships.”
“Like many Americans, they sometimes filmed themselves engaging in sexual acts in their bedrooms,” the document continues. “The videos make clear that the person referred to in the indictment as ‘Victim-I’ not only consented, but thoroughly enjoyed it.”
This does not mean that every sexual encounter between two people is consensual. Diddy’s attorneys also said the tapes were not seized during a search of his home or equipment but were turned over by Cassie, rejecting allegations that Diddy held them up as collateral.
Diddy’s legal team went to great lengths to frame the evidence involving Cassie as a domestic dispute. Back in November, they accused the government of editing video of Cassie’s 2016 attack, which showed Diddy savagely punching and kicking Cassie in a hotel hallway.

Diddy prepares for upcoming trial
Diddy has been in jail since his arrest on September 16, 2024, charged with sex trafficking, racketeering conspiracy and transportation for prostitution. Much of the indictment revolves around alleged drug-fueled orgies, in which authorities say Diddy forced some people to participate through fear, coercion or drug use. He has been refused bail on several occasions and will remain in custody until his trial is scheduled to begin on May 5, 2025.
