Over the weekend, Diddy filed a motion to dismiss a sexual assault lawsuit filed by an anonymous accuser, claiming she took longer than the allotted time to file.
According to court documents obtained by HipHopDX, the embattled bad boy mogul “categorically denies[ies]The complaint alleges that the “claim-resurrection” provisions of New York City law, the Victims of Gender Motivated Violence Protection Act (VGM), were superseded by state laws, the Adult Survivors Act and the Child Victims Act. Therefore, the plaintiffs should file the lawsuit before August 2021, according to the AP analysis.
Diddy’s publicist did not issue a formal statement, instead pointing to passages in the lawsuit that directly address the matter.
“At the top of Plaintiff’s complaint is a bold, legally irrelevant ‘trigger warning’ designed to focus attention on its allegations of lewdness and depravity,” it reads. “This stunt was designed to highlight baseless and time-barred claims and was designed to bring unnecessary publicity, embarrassment and financial cost to the Combs defendants so that the plaintiffs could extract undue financial gain from them. compensation.
The statement continued: “Mr. Combs and his companies categorically deny the plaintiffs’ decades-long story against them, which has done immeasurable harm to the reputations and business standing of the Combs defendants, even before any evidence has been presented. Damage. Plaintiff cannot claim what day or day of the year the alleged incident occurred, yet claims to be miraculously able to specifically recall the most salacious details…This case should now be dismissed with prejudice to protect Coombs The defendant is protected from further reputational harm and judicial resources are wasted before more parties and others are involved.
In the lawsuit, originally filed in late 2023, the woman alleged that Diddy, then-Bad Boy president Xavier Pierre, and a third man raped her while she was under the influence of drugs and alcohol. She said the incident occurred in 2003 when she was in high school.
An attorney for the woman responded to Diddy’s lawsuit saying, “At this point, no one should take seriously anything said by ‘Didi’ or his attorneys. Today’s motion is just a desperate move by Combs to Avoiding responsibility for the gang rape and sexual assault charges against Ms. Doe will not work.
Last month, Diddy argued that another lawsuit against him should be dismissed because he couldn’t be sued for violating a law that didn’t exist at the time.
